Security breach hits U.S. card processors, banks

(Reuters) - The U.S. Secret Service is investigating a major cyber intrusion at an Atlanta-based payment processor that could expose millions of MasterCard, Visa, American Express and Discover cardholders to fraudulent charges.

Processor Global Payments Inc said on Friday it had found "unauthorized access" into its system early in March and notified law enforcement and financial institutions.

Payment network operators MasterCard Inc, Visa Inc, American Express Co and Discover Financial Services confirmed they were affected, along with banks and other franchises that issue cards bearing their logos.

A spokesman for the Secret Service said the agency is leading investigations into the case but declined to give any details.

Though Global Payments is far from a household name, middlemen such as the company are prized targets for hackers because of the vast amount of sensitive financial information they handle.

The company's stock fell more than 9 percent on the news before trading was halted. It said it would discuss the breach in a phone call for investors on Monday.

It was not immediately clear how Global Payments was penetrated or how many accounts were exposed. Consumers who detect fraud usually can be reimbursed. That leaves merchants on the hook financially, though they could file claims against Global Payments.

Analysts said MasterCard and Visa are unlikely to face costs from the breach, but MasterCard shares fell 1.8 percent to close at $420.54 and Visa shares dropped 0.8 percent to $118.

The security breach is just the latest in a long string of incidents that have put the personal information of millions of credit and debit cardholders at risk.

Individual banks and processors said they had not yet determined the full extent of the breach, but the blog Krebs on Security, which first reported the breach, said it was "massive" and could affect more than 10 million cardholders.

Some industry experts suggested the figure might be much lower, perhaps on the order of tens of thousands. Bernstein Research analyst Rod Bourgeois noted that Global Payments is a relatively small player in the transactions services industry, servicing 800,000 merchants with a 3.5 percent market share. By contrast, the largest competitor, First Data, services millions of merchants, with 22.6 percent of the market.

JPMorgan Chase & Co, as well as American Express and Discover, which issue their own cards, said they are monitoring customers' accounts and would issue new cards to anyone whose information may have been compromised.

Citigroup Inc said it has been notified by processors of the breach. Bank of America Corp declined to comment on the matter and Wells Fargo & Co said it was too early to comment on the impact.

Banks and processors emphasized customers would not be held liable for any fraudulent charges that may occur.

Michael Simonsen, chief executive of real-estate research company Altos Research, said he may have been a victim.

Simonsen said he was contacted by Bank of America last week about his Visa card. Although there were no unauthorized transactions, the representative told him a vendor or law enforcement agency had flagged his account as compromised and so he would receive a new one.

"It was very unusual," he said.

PROCESSING PIPELINE

Global Payments, which has about 3,700 employees, was spun off from information-services firm National Data Corp in 2001.?For the fiscal year ended May 31, Global Payment reported revenue of $1.9 billion, up 13 percent from the year-earlier period. According to a company presentation in January, it estimated fiscal 2012 revenue at about $2.15 billion.

Global Payments is scheduled to report fiscal third-quarter results on Wednesday and an improvement is expected. On Wednesday, Sterner Agee raised its stock price target for Global Payments to $65 from $58.

Global Payments is one of dozens of companies that operate along the payment-processing chain, between the time a person swipes a card to pay and the time the payment is delivered.

The account number, expiration date and possibly the cardholder's name is sent from the point of payment to a processor, which then connects to Visa, MasterCard, American Express or Discover. Information is then sent to the card issuer ? often a bank ? which ultimately authorizes the transaction.

The actual transfer of money occurs later.

Processing companies, which perform millions of authorizations each day, are supposed to encrypt card information. But a breach could occur if someone gains access to the system and identifies a gap in the encryption.

The information that was likely collected illegally from Global Payments is called Track 1 and Track 2 data. A person improperly using the information can transfer the account number and expiration date to a magnetic strip on a card and then try to use the card on a website.

Thousands of U.S. banks that issue credit and debit cards receive daily alerts regarding breaches, said Thomas McCrohan, an analyst with Jane Capital Markets.

The illegal use of the data could be stymied if an online merchant asks for the three or four digits printed on a card known as the "CV code."

"The systems can all be made tighter, but if they're too tight no transactions would ever be approved," said Edward Lawrence, a director at Auriemma Consulting Group, a payment systems consultant. "You still have to allow commerce to occur."

Rep. Mary Bono, a California Republican who chairs the House Subcommittee on Commerce, Manufacturing and Trade, condemned the Global Payments breach and urged Congress to adopt stronger data-security legislation this year.

"You shouldn't have to cross your fingers and whisper a prayer when you type in a credit card number on your computer and hit 'enter,'" she said in a statement.

RIPPLE EFFECTS

The breach is the first major instance this year of consumer information put at risk by technological flaws or hacking, but there are plenty of examples of massive data breaches in recent years affecting banks, retailers, technology companies and payment processors.

Last June, Citigroup said computer hackers breached the bank's network and accessed data of about 200,000 cardholders in North America.

Sony Corp also reported several recent attacks, including one last year in which hackers accessed the personal information on 77 million PlayStation Network accounts.

Google Inc suffered a major attack on its Gmail accounts in 2011 that it said appeared to originate in China. Attacks against Gmail users involved direct attempts to compromise accounts by tricking users into revealing information - so-called "phishing" - or by gathering their passwords from other websites, rather than compromising Google systems, according to the company.

Separately, TJX Co Inc and Heartland Payment Systems Inc have had their systems compromised.

On Friday, retailers were already beginning to look for fraudulent purchases from the compromised card accounts stemming from the Global Payments breach. They will bear the financial brunt of those crimes under rules worked out with the card associations and issuers, analysts said.

"Our merchant community is sitting here girding itself and looking at their own fraud-prevention strategies and bracing for the influx of bad transactions," said Tom Donlea, managing director for the Americas at the nonprofit Merchant Risk Council. "After Heartland and after the Sony breach, there was an increase in fraud activity."

Dell calls it quits in US smartphone market

Dell is getting out of the smartphone business in the United States -- wait, you mean you didn't know they were in it?

Let's put it this way: Dell entered the U.S. smartphone market quite late with the Aero (at left), launched in summer of 2010. Now, the company is getting out early, before spending more time and money on their poor-selling Android- and Windows-based devices. Dell's latest models, the Venue Pro (Windows) and Venue (Android) will not be sold any longer in the U.S. They will continue to be sold overseas.

"Mobility products typically have shorter lifecycles than laptops and desktops, and we have decided to no longer offer those two on Dell.com in the United States," said a Dell spokesperson in a statement to msnbc.com.

Jack Gold, principal analyst at J. Gold Associates, told?PCWorld?that Dell's move is probably a good one, and that it may allow the company to better focus on other products, such as tablets that use Windows 8, expected out this fall.

Android phones from Samsung, HTC and Motorola have done very well, and a Nielsen report Thursday says that?49.7 percent of U.S. mobile subscribers owned smartphones as of February, up from 36 percent a year ago.?Android-based phones lead the U.S. smartphone market with a 48 percent share, while Apple's iPhone is at 32 percent, and BlackBerry is at 11.6 percent.

Dell's smartphone appeal has not been domestic. The Texas-based company began selling phones first in countries like Brazil and China before the U.S.?

In the U.S. the company's 5-inch Streak smartphone and tablet did get some positive feedback, and Samsung has gone a similar size route with its Galaxy Note.

Dell's larger Streak tablet hasn't been on a selling streak -- especially compared to other offerings from Apple, Samsung and Amazon.com's Kindle Fire -- but with touch-oriented Windows 8, Dell may be able to better compete in the U.S. tablet market.

The company's decision doesn't preclude it from trying at smartphones again domestically.?"We're looking forward to offering new products and concentrating on expanding our growing mobility solutions portfolio in the future," Dell said in its statement.

Van Gogh's sunflowers are mutants

The whimsical appearance of some of the sunflowers in Vincent van Gogh's paintings isn't the result of the painter's alleged mental illness. Researchers have found that overly-bushy sunflowers are actually the result of a genetic mutation in some strains of the flowers.

The typical sunflower has a brown, seed-filled middle and a ring of yellow petals, but some seem overgrown with petals in "double rows" ? like one variety called the "Teddy Bear" ? and others have scrawny petals and seeds extending nearly to the edge of the flower. The researchers discovered that a genetic mutation is to blame for these differences.

"In addition to being of interest from a historical perspective, this finding gives us insight into the molecular basis of an economically important trait," study researcher John Burke, at the University of Georgia, said in a statement. "You often see ornamental varieties similar to the ones Van Gogh painted growing in people's gardens or used for cut flowers, and there is a major market for them."

Sunflower heads ? actually multiple small flowers called florets ? have a very specific symmetry. The "seeds" are laid out in a special geometric pattern. In a normal sunflower, the outer florets sprout into petals and the inner ones mature into seeds. [See more images of sunflower varieties ]

To understand the genetic basis of this difference, Burke and his colleagues began by making sunflower babies that were a blend of the regular breed and a variety of bushy sunflower. The pattern they saw indicated that a single, dominant gene was responsible for the bushy flowers seen in Van Gogh's paintings.

To double-check their results, they sequenced this gene and looked for it in several commercially available types of sunflowers. They never saw the mutation in flowers that had the traditional sunflower appearance, but always saw it in the fluffy varieties.

The newly discovered mutation changes how the plant regulates where the line between "petals" and "seeds" is drawn. When mutated, the gene can move this boundary either closer to the center of the flower head or farther away from it and closer to the outer layers of florets.

If the boundary line moves toward the center, the flower loses the traditional "sunflower" appearance and looks more like the "Teddy Bear" sunflower. If it moves outward, the flower has more seeds and a dinky layer of petals.

"All of this evidence tells us that the mutation we've identified is the same one that Van Gogh captured in the 1800s," Burke said.

The study was published Thursday in the journal PLoS Genetics.

How to Change Your Wireless Encryption | Computers and ...

Most people know that you need to keep your wireless network secure but how many people know how to check their wireless encryption and maybe even increase it? This tutorial will show you how to access your router, view your existing settings and increase your level of encryption.

Before we start a few words on the different types of encryption. There are basically 4 different types of encryption - WEP, WPA-PSK, WPA2-PSK and EAP. Home users only need to worry about the first 3 whereas EAP will only apply to businesses with a Radius server. Almost all routers and WAP's (wireless access points) by default only come with WEP or even no encryption whatsoever. WEP has some pretty big security failings and can be easily broken using tools off the internet in no time whatsoever!!! WPA is much better but WPA2 is, at the moment, virtually unbreakable. EAP requires a radius server which centralises all access attempts but this is not covered in this tutorial.

Ok open up a browser and type one of the addresses below which corresponds to your router in the address bar. For example mine would be 192.168.1.1

Sky 192.168.0.1

BT 192.168.1.254

Orange 192.168.1.1

TalkTalk 192.168.0.1

Virgin 192.168.1.1

You will then be asked for the router login details. If this is the first time that you have accessed your router then use one of the passwords below. If you have accessed your router before and changed the login details then use those.

Sky username = admin, password = sky

BT username = admin, password = admin

Orange username = admin, password = admin

Talktalk username = admin, password = password

Virgin username = virgin, password = password

Next thing to do is locate the wireless settings. Once located you should be able to determine what type of encryption you have and what the key is. Make sure that you have the highest form of encryption available for your router (either WPA or WPA2) and that your key is made up of both letters and numbers. Keep a record of your encryption key in a safe place for future reference. Before you leave the router settings change the admin login and again keep a copy in a safe place for future reference.

US soldier formally charged with 17 murders

A US soldier was charged Friday with 17 premeditated murders of villagers in Afghanistan, US forces said after a massacre that further frayed already threadbare US-Afghan ties.

Staff Sergeant Robert Bales, of the 2nd Battalion, 3rd Infantry Regiment, was also accused of six counts of assault and attempted murder in the Panjwai district of Kandahar province earlier this month.

The killings -- mostly of women and children -- are believed to be the deadliest war crime by a NATO soldier during the decade-long conflict and have brought new tensions to Washington and Kabul's already difficult ties.

Responding to the charges, a spokesman for Afghan President Hamid Karzai said: "We want justice and we want it as soon as possible," while a spokesman for Bales's home base said it will likely be 18-24 months until any trial.

In a statement, the US military said that under its legal code, "the maximum possible punishment for a premeditated murder conviction is a dishonourable discharge from the Armed Forces, reduction to the lowest enlisted grade, total forfeiture of pay and allowances, and death."

The mandatory minimum sentence for the crimes -- the killings of nine children, four women and four men, and attacks on four children, one man and one woman -- is life imprisonment with the possibility of parole, it added.

There are six US servicemen currently on military death row, officials said, but the last execution was more than 50 years ago.

Bales, 38, is currently being held at Fort Leavenworth in Kansas, and a US forces spokesman said it was "more than likely" the trial would be held in the United States, although the decision would be made later in the process.

But furious relatives of the victims have demanded proceedings take place in Afghanistan.

Haji Samad, an elder who lost 11 members of his family, said: "He committed the crime in Afghanistan. Why he is going to be prosecuted in the US?

"If this man is prosecuted in Afghanistan, we will be relieved, if he is prosecuted in the US, we will be angry, and it will remain a pain in our hearts."

Bales allegedly walked off his base in the southern province of Kandahar under cover of darkness March 11 and killed 17 people in two nearby villages, burning some of their bodies before returning to his base and surrendering.

The massacre has deepened a sense of crisis in the NATO mission and renewed questions about the effect of protracted ground wars on America's stretched force, becoming just the latest in a series of damaging setbacks since January.

The burning of Korans by Americans in mid-February triggered deadly anti-US protests, there has been a surge in "insider" attacks on NATO troops by Afghan forces and a video emerged of US Marines urinating on the bloodied corpses of Taliban militants.

The next stage in the Bales case will see him appear before a so-called Article 32 hearing, which will decide whether to proceed with a court-martial -- but the military has almost four months in which to hold it.

His lawyer John Henry Browne, who visited his client for the first time this week, has told reporters that Bales suffered from amnesia.

"He has an early memory of that evening and he has a later memory... but he doesn't have memory of the evening in between," Browne told CBS News.

The lawyer said he could pursue the case on the grounds of "diminished capacity" due to an emotional breakdown.

But Haji Noor Mohammad, who lost his grandfather, grandmother, a sister and a cousin told AFP: "If he is truly crazy and had lost his memory then why he is appointed as a US soldier? Why is he not admitted to the hospital instead?"

A decorated veteran who served three times in Iraq before deploying to Afghanistan in December, Bales suffered a traumatic brain injury during a road accident in Iraq.

Bales and his wife were reportedly also facing financial problems, with news reports saying he owes $1.5 million from a 2003 arbitration ruling in which he was found guilty of securities fraud.

The sergeant's monthly pay is listed as $3,243.30 on the charge sheet released by Joint Base Lewis-McChord, south of Seattle, where he was based and where his family was moved to after the incident, for their protection.

The charge sheet had the names of the victims blanked out, and listed the injuries sustained by the survivors, including gunshots to the neck, head, chest, thigh and groin, according to the charge sheet.

A Fort Lewis-McChord spokesman said the trial is likely to be either there or at the Kansas base, and will likely not be held for at least 18 months.

"It's going to be a long process -- normally between 18 to 24 months before it actually would go to trial, if it goes to trial," spokesman Chris Ophardt told AFP.

After the massacre, it was widely reported that 16 people had been killed, but the US military spokesman in Kabul said prosecutors had evidence that "indicates 17 victims of premeditated murder."

(AP) ? Rick Santorum looked for a win in Louisiana's primary Saturday to boost his Republican presidential campaign while front-runner Mitt Romney braced for an expected loss.

No matter who wins the state, the overall trajectory of the fight for the party's nomination was unlikely to change. Santorum still dramatically lags in the hunt for delegates to the GOP's summertime nominating convention, and Romney remains the prohibitive favorite to become the nominee.

Even so, Santorum made clear he would press on beyond Louisiana and spent Saturday campaigning in next-up Wisconsin, which votes April 3 and represents one of his last chances to beat Romney in a Midwestern state.

"Stand for your principles. Don't compromise. Don't sell America short," Santorum implored Wisconsin voters in Milwaukee, telling them that he expected their state to be "the turning point in this race."

In an unmistakable jab at Romney, Santorum added: "Don't make the mistake that Republicans made in 1976. Don't nominate the moderate. When you do, we lose." It was a reference to Ronald Reagan losing the 1976 Republican nomination to incumbent President Gerald Ford, and Democrat Jimmy Carter winning the White House.

Exit polls conducted for The Associated Press and the television networks showed that the bad economy was the top issue for Louisiana voters, and most were gloomy about prospects for a recovery, saying they felt the economy was getting worse instead of better. While some national surveys suggest Americans are feeling optimistic about economic improvement, just one in eight Republican primary voters said they thought a recovery was underway.

Beating President Barack Obama in the fall was the most important consideration for about four of every ten Louisiana voters.

The former Pennsylvania senator badly needed a rebound after a decisive Illinois loss to Romney earlier in the week that moved party stalwarts to rally around the former Massachusetts governor. Many urged Santorum and fellow candidate former House Speaker Newt Gingrich to drop out of the race.

Both refused, and campaigned aggressively in Louisiana in hopes that a victory there would justify them continuing their bids despite Republican worries that the drawn-out nomination fight could hurt the party's chances this fall against President Barack Obama. The Democratic incumbent faces no serious primary challenge and his re-election campaign already is well under way.

Romney barely campaigned in Louisiana, though his allies spent on TV ads there. Instead, Romney was looking past the results and toward the general election.

"I want the vote of the people of Louisiana so we can consolidate our lead," Romney said Friday while campaigning in Shreveport. He told supporters his campaign wants to focus on "raising the money and building the team to defeat someone that needs to be out of office in 2012, and that's Barack Obama."

Romney is far ahead in the delegate count and on pace to reach the necessary 1,144 delegates before the party's convention in August.

After the Illinois primary March 20, Romney had 563 delegates, according to an Associated Press tally. Santorum had 263, while Gingrich trailed with 135. Texas Rep. Ron Paul had 50.

Santorum looked to add another Southern state to his win column after beating Romney in Alabama and Mississippi, raising questions about Romney's ability to connect with the party's conservative base, particularly in its Southern heart.

In the run up to Saturday, Santorum found himself on the defensive after suggesting he'd prefer a second term for Obama over a Romney presidency. Santorum was all but forced to walk back those comments, saying less than 24 hours before Louisiana polls opened that "over my dead body would I vote for Barack Obama."

Romney also faced trouble this week when a top aide compared the switch from a primary to a general election campaign to an Etch A Sketch toy, suggesting earlier campaign positions could be easily wiped away. Most Louisiana voters said they weren't concerned with the comment, with only about one in five in exit polls calling this week's Etch A Sketch controversy an important factor in their vote.

Louisiana's complicated delegate rules meant that Santorum could walk away with a handful of delegates even if he won the state. That's because even though there were 20 delegates at stake Saturday, they are awarded proportionally to the candidates who receive more than 25 percent of the vote.

Most states divide all the available delegates among the candidates who meet the minimum threshold. Louisiana's system is strictly proportional, with any leftover delegates designated as uncommitted, meaning they will be fought for at the state convention.

None of the candidates remained in the state on Saturday, with Santorum and Gingrich moving on to Pennsylvania. Santorum also campaigned in Wisconsin. Romney and Texas Rep. Ron Paul had no public events Saturday.

Like Santorum, Gingrich showed no inclination to leave the race ahead of the August convention. "There's no incentive to get out as long as there's an opportunity to be there if it gets unlocked," Gingrich told reporters after delivering a Saturday speech to the Pennsylvania Leadership Conference, the state's largest annual gathering of conservatives.

The next key fight comes Tuesday in Wisconsin. Romney's campaign is airing TV ads in the state, and his super PAC allies have plowed more than $2 million into TV advertising there.

Also voting April 3 are Maryland and the District of Columbia. There are 95 delegates combined at stake in the three contests.

Santorum is not on the ballot in Washington, D.C., but is ahead in opinion polls in Maryland.

NEW YORK (AP) ? The father of a black teenager shot to death by a neighborhood watch captain in Florida said he was "honored" by a march being planned for New York City in support of his son.

"I feel very honored that New York would do a rally in my son's honor," Tracy Martin told The Associated Press on Wednesday, hours before what was being called the Million Hoodie March was supposed to take place.

"It means a lot to me and my family knowing that people across the country, across the world, are coming together to get justice for Trayvon."

Martin's son, 17-year-old Trayvon Martin, was killed Feb. 26, in Sanford, Fla. He was returning to a gated community in the city after buying candy at a convenience store. He was unarmed and wearing a hooded sweat shirt at the time.

The shooter, George Zimmerman, has not been charged in the shooting and has said he shot the teen in self-defense after Martin attacked him. Police said Zimmerman is white; his family says he is Hispanic.

The case has ignited a furor against the police department of the Orlando suburb of 53,500 people, prompting rallies and a protest in Gov. Rick Scott's office Tuesday. The Justice Department's Civil Rights Division said it is sending its community relations service this week to Sanford to "address tension in the community."

Earlier in the week, the federal agency opened a civil rights probe into the shooting, and in Florida, Seminole County State Attorney Norm Wolfinger said a grand jury will meet April 10 to consider evidence in the case.

Martin said he and his son's mother, Sybrina Fulton, found out about the march after arriving in New York City, where they have done some interviews about the situation. They got in touch with the organizers to say they would come and speak to the attendees.

The timing of Martin's parents being in the city when the march is happening is "incredible," said Daniel Maree, one of the organizers. He heard about the case earlier this week, he said.

"I was outraged and wanted to do something about it," Maree said.

In recent days, information surrounding the teen's death has been coming out, including 911 calls, and on Tuesday, an account from his family's lawyer of a conversation he had with his girlfriend in the moments before his death was released.

Asked how he was holding up as all this information comes out, Tracy Martin said he was trying to stay strong.

"I don't feel this is the time to break down, even though it's a very troubling time in my life," he said. "I've told myself, when I get justice for Trayvon, then I'll have my time to break down."

Logitech selects Bracken Darrell as president right now, next CEO in 2013

When current CEO Guerrino De Luca took over the reigns at Logitech following huge losses on Google TV and its business in the EMEA region, we knew it was only temporary and now Logitech has appointed a successor. Bracken P. Darrell is coming over from Whirlpool (where he lead its efforts in, you guessed it, Europe, Middle East and Africa) to be its new president effective April 9th. The plan is for him to take over for De Luca on January 1st, 2013 (who will return to his former role as Chairman), while leading an improved, slimmed down product roadmap -- the theme is said to be quality over quantity -- for the second half of the 2013 fiscal year. On the conference call De Luca indicated more would be revealed during an upcoming earnings announcement in April which, combined with a hint at a Harmony remote refresh during the last call in January, has us marking our calendars already.

Tribe, developer battle over Grand Canyon Skywalk

As the muddy Colorado River flows in the plunging depths below, tourists gingerly step onto a glass walkway jutting out over the rim of the Grand Canyon for an experience that gives the illusion of walking on air.

Some pose with arms outstretched for pictures while others ease over a horseshoe-shaped skywalk that is the subject of a bitter tug-of-war between an Arizona Indian tribe on whose ancestral land it was constructed and a developer who spent at least $30 million to build it.

The tiny Hualapai nation, in a bold move that could serve as a test of the limits of the sovereign power of Native American tribes over non-members, exercised its right of eminent domain last month to take over the management of the site and kick out the non-Indian developer.

The dispute over the potentially lucrative Skywalk -- which all agree could draw up to 3,000 visitors a day -- pits the tribe's sovereign rights over a site it sees as its economic lifeblood against a developer's contractual right to manage the attraction for 25 years and share the profits.

"We've made this decision, and we've done it for what's in the best interests of the people," said Candida Hunter, 32, a member of the Hualapai Tribal Council who voted to take over the Skywalk as the dispute dragged on, abandoning a contract-mandated arbitration process.

"We've been in negotiations with them, we've tried to work with them. It was our last option really," she said of the seizure. "We just need to move forward now."

The dispute at the heart of the crisis appears to center on specifications including who was supposed to provide infrastructure -- power, water and sewer -- for the project, with both sides accusing the other of acting in bad faith.

What is not in dispute is that a visitors' center overlooking the Skywalk -- a beautiful building on the edge of the canyon with floor-to-ceiling windows where a restaurant might have been -- is nothing but a shell.

Construction on the center stopped several years ago -- the sides disagree as to why -- and the building lies unfinished and vacant, with bales of insulation piled up and gathering dust on its bare concrete floor.

Visitors who drive to the site, often as a day trip from Las Vegas, must traverse a long windshield-busting stretch on a dirt road. Others fly in by helicopter or plane to the reservation's busy airport.

Legal precedent
The Hualapai council members say the unfinished site is an embarrassment to the tribe, which approved the project despite some internal objections about building on land roughly 30 miles from a place central to the Hualapai creation story. Traditional tribal belief places man's origin on Hualapai lands.

"I believe the canyon is a sacred place. The Hualapai look at is as a church. Why take trash and throw it in the church. I voted against it," said Philip Bravo, a former council member. "What does the tribe have out there? A half-finished building."

Angry at the developer, the tribe passed an ordinance last year creating a legal path to effectively cancel the developer's contract through the sovereign right of eminent domain.

The tribe set compensation for the seizure at $11.4 million, a sum they said represents the fair value of a project that the Las Vegas-based developer says is worth over $100 million.

"They took everything. And then the tribal court issued an order that we were trespassers if we were even there. You do understand this is like Hugo Chavez's Venezuela, don't you?" said Troy Eid, a lawyer for the Grand Canyon Skywalk Development Corporation, which built the skywalk.

There is little doubt that tribes can legally seize property for the public good, much like a state or the federal government. But by seizing a non-tangible asset of a non-Indian company as a way to escape a contentious business deal, the tribe may have stepped into untested waters.

"I think on first glance the tribe is exercising a power that they have. Whether they are exercising it wisely is a different question," said Addie Rolnick, an expert in Indian law at the University of Nevada at Las Vegas.

The tribe says it is hoping to get estimates from other developers on how much it might cost to finish the visitors' center to the tribe's specifications.

Ted Quasula, general manager for the Skywalk Development Corporation who said the tribe fired him from Skywalk management as one of their first acts when they took over operations, feared the seizure could impede future development.

"I've had many other Indians from other reservations tell me that, 'What's wrong?' He puts up $30 to $40 million, whatever it is, and then they want to kick him out? ... It makes us look kind of ungrateful," said Quasula, himself a Hualapai tribal member.

Tourism a mainstay
The tribe initially agreed to the project to secure its economic future, and has since seen tourism revenues soar to $40 to $50 million a year, more than double what they were in 2006, the year before the skywalk opened to great fanfare, Council member Waylon Honga said.

That increase is a testament to the tribe's ability in recent years to capitalize on its prime Grand Canyon location, although it does not direct Skywalk revenue. Due to the dispute, Skywalk revenue has been paid into a trust since 2010.

In the Hualapai town of Peach Springs, where tribal members live in modest one-story matchbox-style homes often surrounded by chain-link fences, that extra money from growing tourism has translated into a building boom.

The revenues, which the tribe is keen to protect, have helped build a brand new health department and a 30-bed juvenile detention center. The tribe hopes to break ground on a child care center by the year's end, Hunter said.

The tourism money also helps fund hefty tuition payments for 81 Hualapai youth enrolled in college full-time, as well as funding for meals on wheels programs and a cultural center where youth can study the tribal language.

"Tourism is what the Hualapai tribe does," Honga said. "We don't do casino gaming, we don't have any timber or oil or coal reserves. All we do is tourism. We do the rafts on the Colorado river. We have a hotel restaurant and we have tours at the Grand Canyon."

Genetic variation in East Asians found to explain resistance to cancer drugs

ScienceDaily (Mar. 18, 2012) ? A multinational research team led by scientists at Duke-NUS Graduate Medical School has identified the reason why some patients fail to respond to some of the most successful cancer drugs.

Tyrosine kinase inhibitor drugs (TKI) work effectively in most patients to fight certain blood cell cancers, such as chronic myelogenous leukemia (CML), and non-small-cell lung cancers (NSCLC) with mutations in the EGFR gene.

These precisely targeted drugs shut down molecular pathways that keep these cancers flourishing and include TKIs for treating CML, and the form of NSCLC with EGFR genetic mutations.

Now the team at Duke-NUS Graduate Medical School in Singapore, working with the Genome Institute of Singapore (GIS), Singapore General Hospital, and the National Cancer Centre Singapore, has discovered that there is a common variation in the BIM gene in people of East Asian descent that contributes to some patients' failure to benefit from these tyrosine kinase inhibitor drugs.

"Because we could determine in cells how the BIM gene variant caused TKI resistance, we were able to devise a strategy to overcome it," said S. Tiong Ong, MBBCh, senior author of the study and associate professor in the Cancer and Stem Cell Biology Signature Research Programme at Duke-NUS and Division of Medical Oncology, Department of Medicine, at Duke University Medical Center.

"A novel class of drugs called the BH3-mimetics provided the answer," Ong said. "When the BH3 drugs were added to the TKI therapy in experiments conducted on cancer cells with the BIM gene variant, we were able to overcome the resistance conferred by the gene. Our next step will be to bring this to clinical trials with patients."

Said Yijun Ruan, PhD, a co-senior author of this study and associate director for Genome Technology and Biology at GIS: "We used a genome-wide sequencing approach to specifically look for structural changes in the DNA of patient samples. This helped in the discovery of the East Asian BIM gene variant. What's more gratifying is that this collaboration validates the use of basic genomic technology to make clinically important discoveries."

The study was published online in Nature Medicine on March 18.

If the drug combination does override TKI resistance in people, this will be good news for those with the BIM gene variant, which occurs in about 15 percent of the typical East Asian population. By contrast, no people of European or African ancestry were found to have this gene variant.

"While it's interesting to learn about this ethnic difference for the mutation, the greater significance of the finding is that the same principle may apply for other populations," said Patrick Casey, PhD, senior vice dean for research at Duke-NUS and James B. Duke Professor of Pharmacology and Cancer Biology.

"There may well be other, yet to be discovered gene variations that account for drug resistance in different world populations. These findings underscore the importance of learning all we can about cancer pathways, mutations, and treatments that work for different types of individuals. This is how we can personalize cancer treatment and, ultimately, control cancer."

"We estimate that about 14,000 newly diagnosed East Asian CML and EGFR non-small-cell lung cancer patients per year will carry the gene variant," Ong said. "Notably, EGFR NSCLC is much more common in East Asia, and accounts for about 50 percent of all non-small-cell lung cancers in East Asia, compared to only 10 percent in the West."

The researchers found that drug resistance occurred because of impaired production of BH3-containing forms of the BIM protein. They confirmed that restoring BIM gene function with the BH3 drugs worked to overcome TKI resistance in both types of cancer.

"BH3-mimetic drugs are already being studied in clinical trials in combination with chemotherapy, and we are hopeful that BH3 drugs in combination with TKIs can actually overcome this form of TKI resistance in patients with CML and EGFR non-small-cell lung cancer," Ong said. "We are working closely with GIS and the commercialization arm of the Agency for Science, Technology & Research (A*STAR), to develop a clinical test for the BIM gene variant, so that we can take our discovery quickly to the patient."

The major contributors to the study include additional researchers and teams from the Duke-NUS Graduate Medical School, Genome Institute of Singapore (Dr. Yijun Ruan and Dr. Axel Hillmer), Singapore General Hospital (Dr. Charles Chuah), and National Cancer Centre Singapore (Dr. Darren Wan-Teck Lim).

In addition, the investigators also received important contributions from Akita University Graduate School of Medicine, Japan (Dr. Naoto Takahashi), the Cancer Science Institute of Singapore (Dr. Ross Soo), the National University Cancer Institute of Singapore (Drs. Liang Piu Koh and Tan Min Chin), the Yong Loo Lin School of Medicine, National University of Singapore (Dr. Seet Ju Ee), the University of Bonn, Germany (Dr. Markus N?then), the University of Malaya (Dr. Veera Nadarajan), and the University of Tokyo, Japan (Dr. Hiroyuki Mano).

The study was supported by grants from the National Medical Research Council (NMRC) of Singapore; Biomedical Research Council (BMRC) of A*STAR, Singapore; Genome Institute of Singapore; Singapore General Hospital; and two NMRC Clinician Scientist Awards to Dr. Ong and Dr Chuah.
